The processing time for an EB-5 visa depends almost entirely on the category you file in. Rural I-526E petitions are decided in about 9.6 months on average, 77% within a year; high-unemployment petitions run 17–52 months; unreserved 30–61. After approval come the green-card stage, two years of conditional residence and an I-829 that takes about 20 months. If you are in the US, concurrent filing secures a work permit well before these later stages.

EB-5 application process and processing time at each stage

Durations are 2026 averages or ranges; USCIS publishes its own figures and we check them at every filing.

1. Strategy, project and tax review (2–6 weeks)

We settle the category (rural for most), the project, and the cross-border tax plan for Canadians. Nothing is filed yet.

2. Source-of-funds file (1–3 months)

The longest stage within your control. Bank statements, tax returns, sale contracts, gift documentation, each traced to origin. An incomplete file here is the usual cause of a request for evidence later.

3. Invest and file I-526E (Filing day)

Capital to escrow or the enterprise; regional-centre fee paid; I-526E filed with the US$11,160 fee and the US$1,000 integrity-fund fee. Your priority date is set. If you are in the US in valid status, I-485, I-765 and I-131 are filed the same day.

4. Employment authorisation and advance parole (Typically within months)

Concurrent filers receive the combined employment authorisation and advance parole card and can work for any employer, or none, and travel. This is a principal reason H-1B and F-1 holders choose EB-5.

5. I-526E decision (Rural about 9.6 months; high-unemployment 17–52; unreserved 30–61)

USCIS reviews the project and your funds. A request for evidence adds two to four months; most are answered and approved.

6. Green-card stage (3–12 months)

In the US: I-485 approval, often without an interview. Abroad: National Visa Center, then the consular interview and entry with an immigrant visa. Conditional green card valid two years.

7. I-829, removal of conditions (About 20 months)

Filed in the 90 days before the second anniversary. Your conditional status is automatically extended while it is pending. Approval brings the 10-year permanent card.

Averages mask variation: some rural petitions clear in six months, some take fifteen. USCIS posts its times monthly at egov.uscis.gov and the Department of State posts visa availability in the Visa Bulletin. Figures verified 27 September 2026.

EB-5 interviews, biometrics and division of responsibilities

Biometrics are taken at a USCIS application support centre for I-485 filers, usually within weeks of filing, and at the consulate for immigrant-visa applicants. USCIS interviews some I-485 applicants and waives others; consular applicants are always interviewed, and Canadians normally use Montreal. There is no interview for I-526E itself. Medical exams are required at the green-card stage.

What you do: gather documents early, keep the capital untouched for the sustainment period, keep your status valid until I-485 is filed, and avoid international travel between filing and the advance parole card if you are adjusting in the US. Two dates are critical this year: 30 September 2026 for regional-centre grandfathering, three days after our verification date, and 1 January 2027 when the minimums index.

For Canadian citizens

Canada is current in every category, so your timeline is the rural one: about 10 months to an I-526E decision, then Montreal, then the move. Inside the US in TN, E-2 or L-1 status you file I-485 concurrently and avoid consular processing. Use the wait to complete departure-tax planning; the green card makes you a US tax resident on worldwide income the day it issues.

For US and Canada residents on another passport

For an Indian or Chinese national in the US, the category determines the timeline. Rural or high-unemployment: current, concurrent filing, a work permit in months. Unreserved: 30–61 months to a decision and then a Visa Bulletin wait measured in years. File in a set-aside, and file while it is current.

Congress gave rural petitions priority processing in the 2022 Reform and Integrity Act, and USCIS has honoured it: about 9.6 months on average, 77% within a year. If you file rural, the rural average applies to you, not the headline figure.

How fast is the EB-5 work permit with concurrent filing?

Employment authorisation and advance parole are filed with I-485 on the same day as I-526E and typically arrive within months. You must be in the US in valid status on the filing date and your category must be current, which rural and high-unemployment are for every country.

Does the EB-5 timeline differ for Canadians?

Only in the green-card stage. Canada has no backlog, so the I-526E time is the category average. Canadians in Canada process at the consulate in Montreal after approval; Canadians inside the US in valid status file I-485 concurrently and never leave.

What happens to my status while I-829 is pending?

It continues. A timely filed I-829 automatically extends your conditional residence, and USCIS issues a receipt notice that serves as proof of status for work and travel while the roughly 20-month adjudication runs. Your family members covered by the petition are extended with you. Time in this period counts towards the five years for citizenship.
